1. The service and its publisher

Eat The Iceberg is published by Kany Aïcha Diakhaté, sole trader, 10 rue Florence Arthaud, 76100 Rouen, France. Full details are set out in the legal notice.

The service lets you read, document and discuss marketing experiments that were actually run, take part in themed spaces and keep a personal working space.

The service is currently offered without any paid plan. If a paid offer is introduced, separate sales terms will be published before it becomes available.

2. Scope

These terms apply to any use of the service, whether you are a visitor or a member with an account. Eat The Iceberg is intended mainly for professional uses, but access is not legally restricted to professionals: an individual may create an account without declaring that they act in the course of a professional activity. Consumers are not excluded and retain any mandatory rights that apply to them. Some features, in particular publishing and the personal working space, require an account.

3. Account creation and capacity

Creating an account requires a valid email address and a password that meets the security rules shown. You confirm that you have the legal capacity to do so and, if you act for an organisation, the authority to bind it.

The service is not intended for people under 15.

The information you provide must be accurate and kept up to date.

4. Acceptance and versions

Accepting these terms is required to create an account. The accepted version, the date of acceptance and the language displayed are recorded.

When a new version contains substantial changes, you are asked to accept it again before continuing to use the service. Minor changes are published without a new acceptance, and the update date remains visible on this page.

This acceptance is a contractual commitment. It is not consent to receive marketing communications, nor consent to any tracker: those choices are separate and managed separately.

5. Account security

You are responsible for keeping your credentials confidential and for the actions taken from your account. If you notice unauthorised use, change your password and report it to hello@eat-the-iceberg.com.

6. Profile and visibility choices

You choose whether your profile is public. A public profile shows the information you entered for that purpose: display name, professional headline, introduction, declared specialties, published contributions and featured experiments.

You can change this choice at any time from your space.

7. Experiments

An experiment documents something you actually did: context, hypothesis, protocol, results and learnings. You undertake to describe faithfully what you observed and not to present as verified what is not.

Experiments are reviewed before publication. Publication may be refused or postponed, in particular where content is incomplete, misleading, promotional or contrary to these terms.

No result is guaranteed. An experiment describes one specific situation; it is neither personalised professional advice nor a promise of performance in another context.

8. Community contributions

Questions, answers, posts and comments reflect the experience of their authors. They are not a recommendation guaranteed by Eat The Iceberg.

You can delete your own contributions. Where other members have replied to a thread, its structure may be kept so the discussion stays readable, with your identity dissociated from it.

9. Personal working space

The Experimental Notebook is private: its notes and files are accessible only to you. It never appears in search or on public pages.

Do not place there data you are not entitled to process, in particular third-party confidential information or other people's personal data without a valid basis.

10. Prohibited behaviour and content

The following are prohibited, among others:

• unlawful, defamatory, hateful, harassing or discriminatory content;
• misleading or invented content, or content presented as an observed result when it was not;
• infringing third-party rights, in particular intellectual property rights;
• publishing third-party personal or confidential data without authorisation;
• using the service for cold outreach, spam or automated scraping;
• attempting to circumvent security, access or moderation mechanisms.

11. Third-party data

When you publish material from your professional activity (screenshots, figures, client cases), you are responsible for having the right to share it and for the absence of unauthorised personal or confidential data. Anonymise or remove such material before publishing where necessary.

12. Moderation and reporting

Content can be reported from within the service. Content contrary to these terms may be hidden, removed or subject to a publishing restriction, in a proportionate way.

In the event of a serious or repeated breach, an account may be suspended. You may challenge a decision by writing to hello@eat-the-iceberg.com.

13. Pausing, deletion and end of the relationship

You can pause your account at any time: your public profile is hidden and publishing is suspended, while your data is kept until you reactivate.

You can request permanent deletion of your account. It is carried out after a 7-day period during which you can still cancel it.

After deletion, your published experiments are no longer publicly accessible and your identity is dissociated from them; their structured content may be kept internally to preserve the consistency of the knowledge base. Threads other members replied to remain readable without your identity. Details are in the privacy policy.

14. Service evolution and availability

The service evolves: features may be added, changed or removed. It is provided as is, without any guarantee of uninterrupted availability. Interruptions may occur for maintenance or for technical reasons beyond the publisher's control.

15. Intellectual property

The brand, visual identity, editorial texts, architecture and components of the service are protected. Any substantial reuse without authorisation is prohibited.

You remain the owner of your original contributions.

16. Licence over your contributions

So that the service can operate, you grant the publisher a non-exclusive, royalty-free, worldwide licence, limited to what is necessary to operate the service and for as long as your content is published, in order to:

• host, store and back up your contributions;
• reproduce them technically in order to display and deliver them within the service;
• display them according to the publication and visibility choices you made;
• offer a translated version between French and English;
• organise, classify and index them for internal search;
• moderate them and, where appropriate, hide or remove them;
• preserve the consistency of the collective knowledge base as described in these terms.

This licence transfers no ownership. It ends when you remove a piece of content, subject to the retention described in section 13 and in the privacy policy, and to temporary technical copies.

These terms grant no right to use your contributions to train an artificial-intelligence model. No such training takes place today. Any such use would require a prior legal assessment, updated information and, where applicable, a dedicated rights or consent mechanism.

17. External links

The service may contain links to third-party sites, in particular those cited by members. The publisher does not control their content and accepts no responsibility for it.

18. Liability

The publisher takes reasonable steps to keep the service working properly and to present content accurately. It is not responsible for decisions you make on the basis of an experiment or a contribution, nor for the results you obtain.

The publisher is not responsible for content published by members. Nothing in these terms limits the publisher's liability where the law does not allow it.

19. Changes to these terms

These terms may change to reflect the evolution of the service or of applicable regulation. The update date is shown at the top of this page and substantial changes require a new acceptance.

20. Governing law and disputes

These terms are governed by French law, without prejudice to the mandatory protective provisions applicable in your country of residence.

In the event of a dispute, please contact us first at hello@eat-the-iceberg.com so we can look for an amicable solution. Failing that, the dispute falls to the courts having jurisdiction under ordinary rules.

21. Language versions

These terms are provided in French and in English for accessibility. In the event of a discrepancy of interpretation on a substantial point, the French version is the reference version, without depriving the user of the mandatory rights they benefit from.
